These terms apply when you use WindItDown ("we", "us", "the platform"). By creating an account or using the site, you agree to them.
What WindItDown is
WindItDown is a platform and service for closing simple, debt-free Australian businesses with ASIC — Pty Ltd companies eligible for voluntary deregistration, and sole traders winding down their ABN. On the DIY plan we provide guided information, checklists and document preparation support; on paid done-for-you plans we prepare and lodge the forms with ASIC ourselves.
We are not a law firm, accounting firm, tax agent or insolvency practice, and nothing on this platform is legal, tax, accounting or insolvency advice. Where your situation involves debt, disputes, or possible insolvency, we'll tell you and point you to a registered professional instead of guiding you through it ourselves.
Who can use it
You must be at least 18, and authorised to act on behalf of the business you're closing (as a director, or the sole trader themselves). The information you give us — including your ABN/ACN and business details — must be accurate and belong to a business you're actually authorised to close.
Your account
You're responsible for keeping your login details secure and for anything that happens under your account. Tell us straight away at hello@winditdown.com if you think your account's been compromised.
Plans, fees and payment
Current plan pricing is shown on our pricing page. Plan fees are one-off charges, paid when you select a plan. Records vault storage is included in every plan at no extra cost. Prices include GST where applicable. Where a plan says a government fee is included, we cover the ASIC lodgement fee current at the time you use the service.
Nothing in these terms limits any guarantee, right or remedy you have under the Australian Consumer Law that can't lawfully be excluded. Beyond that, because our plans involve real work and, in some cases, lodgement with ASIC on your behalf, fees are generally non-refundable once we've started work on your application — but if something's gone wrong, contact us and we'll work it out with you.
What we ask of you
- Give us accurate, complete information about your business
- Tell us promptly if your situation changes — for example, if a debt or dispute arises after you've started
- Understand that you remain responsible for your own legal and tax obligations throughout
What we don't guarantee
We can't guarantee that ASIC, the ATO, or any other authority will approve an application, or guarantee timeframes that are outside our control. We'll do our part correctly and on time; the rest is up to the relevant authority.
Liability
To the extent the law allows, our liability to you is limited to re-supplying the service or refunding what you paid for it. We're not liable for indirect or consequential loss. Nothing here excludes any guarantee under the Australian Consumer Law that cannot lawfully be excluded.
Ending your account
You can close your account at any time by contacting us. We may suspend or close an account that provides false information, misuses the platform, or breaches these terms.
Changes to these terms
We may update these terms from time to time. We'll update the date at the top of this page when we do, and material changes will be communicated to active account holders.
